PLAN FOR THE MASS LEGALIZATION OF 2.5 MILLION ILLEGAL PROPERTIES

The Director of the Republic Geodetic Authority (RGA) Borko Drašković stated that work is underway on the proposal of the new Law on Legalization, as well as that the envisaged solutions are moving in the direction of "mass" legalization.

At the constitutive meeting of the Association for Property and Investments of the National Alliance for Local Economic Development (NALED), Drašković said that thanks to satellite images, the RGZ recorded all illegally built buildings in Serbia, which is a prerequisite for the legalization procedure.

When asked what are the elements that will make the future process of legalization "massive", Drašković replied that the resolution of property and legal matters is key to ensuring mass, writes biznis.rs.

"There are three situations - when you built on your own land, on someone else's land and on public land. The speed with which the legalization will be carried out depends on the way of solving property-legal issues, that is, the problem is not of a technical nature, but rather a matter of establishing rights. We are ready to register any type of rights, and in what kind of procedures the rights will be determined, that is a question dealt with by the Ministry of Construction, Transport and Infrastructure", said Drašković and added that the simplest case is "if you built on your own property".

"If you built on state land, you will have to come to an agreement with the state, while the most complicated situation is if you built on someone else's land, because in that case the rightful owner must receive fair compensation, and that is where an 'elegant' and correct legal solution is required", Drašković said.

He also reminded that there are five million buildings in Serbia that are not registered in the cadastre, and that it is estimated that there are 2.5 million illegal buildings among them.

Member of the Presidency of the Association for Property and Investments NALED, lawyer Dejan Vuković, drew attention to the fact that unregistered buildings represent a huge but "dead" property, which cannot be traded because, as he pointed out, if those five million buildings are multiplied by the average with a real estate value of 50,000 euros, 25 billion euros is obtained.

The Association for Property NALED announced at today's constitutive session that among the reform priorities for the next period they put the implementation of mass legalization in the first place, in order to improve the procedure for legalizing illegal buildings, as well as establishing a unique information system for legalization.

On the list of priorities of the Association for Property and Investments is the abolition of the fee for conversion, that is, the conversion of the right of use into the right of ownership over construction land, and in its Gray Book of Recommendations for 2022 NALED took the position that it is necessary to enable the automatic registration of ownership rights in the cadastre for all persons who have the right to use the land, including those persons who are liable to pay the fee for the conversion, as well as for the conversion to be free of charge.

Regarding the conversion and procedure of registration of ownership rights, Drašković said that from the point of view of RGZ, the most important thing is to find a solution that would ensure that the registration is digital, direct and automatic.

The Association for Property and Investments NALED today also elected a new presidency, which will be headed by MK Group Board of Directors member Andrija Vuković, Tanja Vukotić Marinković from the Agency for Business Registers, Director of General Affairs A1 Marko Jović and Mayor of Užice Jelena Raković Radivojević.
